Welcome to the Simply Rooms Website Terms & Conditions for Use. These terms and conditions apply to the Use of this website and by accessing this website and/or placing an order You agree to be bound by the terms and conditions set out below. If You do not agree to be bound by these terms and conditions You may not Use or access this website.

1. Definitions 

  • "Conditions" means these term and conditions.
  • "Product(s)" means a product or products displayed for sale on the website.
  • "Product Description" means the information provided on our website unique to each Product which outlines the main characteristics of that Product, the Estimated Delivery Date, and the price of the Product.
  • "Estimated Delivery Date" means the date on which we aim to have the Product delivered to You.
  • "We/Us" means Simply Rooms Limited.
  • "Website" means the website located at www.simplyrooms.co.uk
  • "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands.
  • "You" means a user of this website.

3. Using This Website

You undertake that all details you provide to us for the purpose of purchasing goods or services which may be offered by us on our website will be correct, that credit or debit cards, or any electronic cash, which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any Products. We reserve the right to obtain validation of your credit or debit card details before providing you with any Products.

We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including the content, and/or the sale of new Products shall be subject to these terms and conditions.

We will try to make our website available but cannot guarantee that our website will operate continuously or without interruptions or be error free and can accept no liability for its unavailability. You must not attempt to interfere with the proper working of our website and, in particular, you must not attempt to circumvent security, tamper with, hack into or otherwise disrupt any computer system, server, website, router or any other internet connected device.

4. The Contract between You and Us

How the contract between You and Us is completed

  • You must open an account with the Website in order to purchase Products.
  • You should click on a Product which interests You.
  • You will be shown a Product Description and availability information.
  • A price shall be displayed beside the Product. All prices shown on this Website include Value Added Tax at 20%. The price shall be displayed in POUNDS STERLING (GBP). We do not accept any other currency in payment of the price. The price shown does not include delivery charges. You will be shown the delivery charges before You confirm Your order. Alternatively You may view our delivery charges below.
  • If You wish to purchase the Product You should click ADD TO SHOPPING BAG.
  • If You see any errors in Your order You can amend Your order at this point. You can also clear Your order details by clicking the REMOVE BUTTON against each product ordered or by amending the quantity to zero. Please note that promotional codes cannot be used in conjunction with sale items, discounted items, or any other offers. When you are happy with Your order You will then be asked to confirm your billing address and your delivery address. When You have done so You should click MAKE PAYMENT.
  • This shall allow You to view a summary of Your proposed order. On this page You will be asked to confirm that You have read our Terms and Conditions. If You do not confirm You have read our Terms and Conditions You cannot place an order with Us. If You are satisfied with the Products selected and the total price including delivery charges You should click MAKE PAYMENT NOW.
  • On the next page You should select Your payment method then enter Your payment details. You must make payment by using a valid credit or debit card. You should then click PROCEED. You will have one final opportunity to view your order and if you are happy to offer to purchase the Product(s) from Us you should click PROCEED again. You will then be shown a message confirming that payment has been taken. Receipt of payment does not establish a contract between You and Us. By placing an order with Us You are offering to purchase the goods You have ordered. The contract between You and Us is only formed if we accept Your order. We shall send You a confirmation email within one working day advising You whether we accept Your order or reject Your order. If Your order is rejected, You will be given a full refund immediately after we reject Your order.

Important Contractual Matters

  • We shall not enter into a Contract with You and reject any order You place if You are under the age of 18 years old.
  • We shall not enter into a Contract with You and reject any order You place if You are not resident in the United Kingdom. We must also reject any order you place if the Product is to be delivered to Scottish Highlands and Islands, Isle of Wight, Channel Islands or Northern Ireland due to current delivery limitations.
  • We cannot retrospectively apply a promotional code to your order. If you place an order without correctly applying the promotional code, we will be unable to reimburse You the discount once the order has been placed. If you are having difficulty applying your code or believe your code to be faulty, please contact us and we will gladly investigate this for you. Please note: To receive FREE standard delivery, the total amount as displayed on the Website at time of purchase or more, must be payable after any promotional discounts have been applied to your order.
  • When delivery is free for orders over a specified amount at the time of purchase and an item is returned which brings the value of your order below the threshold for free delivery, your refund will be adjusted to reflect the fact that the offer is no longer valid.
  • If You require any information regarding orders You have placed with Us please write to Us at our postal address.
  • The contract shall be concluded in English.

Your Right to Cancel

If you have contracted with us as a consumer, you have the right to cancel your contract at any time up to 7 working days after the day on which you receive the goods under the Consumer Protection (Distance Selling) Regulations 2000. Personalised Products are exempt from this rule. If You purchase any Products which are stated to be personalised in the Product Description You cannot cancel the contract between You and Us in this way.

Should you wish to return an item, please refer to our Returns Policy under Point 6.

5. e-Gift Voucher Terms

Purchasing an e-Gift Voucher

  • Sterling e-Gift Vouchers can only be purchased online at simplyrooms.co.uk.
  • e-Gift Vouchers are available in the following denominations: £10, £15, £20, £25, £50, £100, £150, £200, £250 and you can select multiple combinations of vouchers as required.
  • For additional online security, we will verify your payment by using 3D secure. If your bank has joined the 3D secure scheme, you will be asked to enter your 3D secure password at Checkout. If you have not previously used 3D secure, you will have the opportunity to set up your unique password.

Delivery Information

  • A unique e-Gift Voucher code is assigned when purchasing an e-Gift Voucher. You can then send this on by e-mail or print off and place in a card to deliver personally.

Using your e-Gift Voucher (UK Sterling)

  • Simply Rooms e-Gift Vouchers can be used as full or part payment for any goods purchased from our website.
  • If the value of an order exceeds the value of the voucher the balance must be paid by either credit or debit card.
  • The full value of the e-Gift Voucher must be redeemed at Checkout, as any remaining balance cannot be refunded or exchanged for cash.
  • Only one Simply Rooms e-Gift Voucher can be redeemed per transaction.
  • Promotional codes are not valid when buying or redeeming an e-Gift Voucher.

General Terms and Conditions

  • The e-Gift Voucher is redeemable online only.
  • The value of your e-Gift Voucher will expire if not used within 12 months of date of issue.
  • e-Gift Vouchers are non-refundable, non-transferable and no cash alternative will be offered.
  • Simply Rooms cannot accept responsibility for lost voucher codes or email voucher delays in the transmission from internet providers.
  • An e-Gift Voucher cannot be redeemed against delivery charges.
  • Your e-Gift Voucher can only be redeemed in the currency of issue.
  • The purchase of an e-Gift Voucher will be subject to credit/debit card clearance which can take up to 48 business hours. Once authorised, the email detailing your unique e-Gift Voucher code will be sent to you, allowing you to send this on by e-mail or print off and place in a card to deliver personally.
  • e-Gift Vouchers cannot be used to buy further e-Gift Vouchers.

Security and Fraud

  • When you use an e-Gift Voucher you are declaring to Simply Rooms that you are the duly authorised recipient of the e-Gift Voucher and that you are using it in good faith.
  • If you redeem, attempt to redeem or encourage the redemption of an e-Gift Voucher to obtain discounts which you or a third party are not entitled to you may be committing a civil or criminal offence.
  • If we reasonably believe that any e-Gift Voucher is being used unlawfully or illegally we may reject or cancel any e-Gift Voucher and you will have no claim against us in respect of any rejection or cancellation. Simply Rooms reserves the right to remove, block or de-activate an e-Gift Voucher or take any further action it deems appropriate in such instances.

6. Delivery of Products

Standard Delivery

Our standard delivery charge for small items such as clocks, light switch covers, cushions and lampshades is £2.95, general soft furnishings is £4.95 with heavier items such as duvets, rugs, moses baskets, hanging rails, storage items and play tents £6.95 for each order submitted, irrespective of the number of products ordered. For orders containing furniture, please refer to our furniture delivery charges detailed below.

Miscellaneous

At present, We only deliver to addresses in mainland United Kingdom, excluding Scottish Highlands and Islands, Isle of Wight and Northern Ireland. For orders placed for delivery outwith these areas, a price can be obtained on application.

The Estimated Delivery Date for each Product can be found in the Product Description pertaining to each Product. All soft furnishings shall be delivered within 14 days and all furniture items shall be delivered within 6 weeks of the date of acceptance of your order. These and any other times or dates stated on our website for delivery are estimates only; Simply Rooms Limited will make all reasonable effort to deliver goods within the time specified but does not accept liability for any failure to deliver within that time.

If You have ordered more than one Product You should note that Products may be dispatched from multiple locations and may arrive separately. No additional delivery charge shall be incurred by You as a consequence of this.

In the unfortunate event that a Product which You have ordered is out of stock or temporarily unavailable we shall advise of expected delivery date or arrange a full refund.

Please note our carriers deliver between 8am - 5.30pm Monday to Friday.

Please use a delivery address where there is someone available to sign for your items. Please specify any additional delivery requirements in the SPECIAL DELIVERY INSTRUCTION box when you place your order. Simply Rooms will not be held responsible for any charges that may arise due to non-delivery.

In the event of a Product shown to be temporarily out of stock on our Website, you can request to be notified by email when the Product is back in stock by clicking on the Notify Me When In Stock button displayed against the Product.

Personalised Products will be sent separately as soon as they are ready. Please allow up to 28 days for delivery, however please check the Product details for more specific information.

Furniture

Our delivery charges for furniture Products are as follows:-

DELIVERY BAND A : £19.95 Small furniture items, e.g. cot top changers.
DELIVERY BAND B : £24.95 Medium furniture items, e.g. bedside units and drawers.
DELIVERY BAND C : £29.95 Large furniture items, e.g. wardrobes, cots, beds.

Please refer to each Product Description for information on whether furniture items are self-assembly or assembled on delivery.

Furniture Products which do not include installation and assembly shall be delivered to the first room/hallway reached upon entering your premises on the ground floor.

The furniture manufacturers shall call you directly to arrange a delivery date with you. Please ensure you give a landline and a mobile telephone number when submitting your order to allow them to contact you easily. If the delivery team attempts to deliver the furniture to you on the pre-arranged date but are unable to gain entry to the premises due to your failure to be present, you shall incur an additional £60.00 delivery charge for arranging a second attempted delivery.

7. Returns

Your Right to Cancel

If you have contracted with us as a consumer, you have the right to cancel your contract at any time up to 7 working days after the day on which you receive the goods under the Consumer Protection (Distance Selling) Regulations 2000. Personalised products are exempt from this rule. If you purchase any products which are stated to be personalised in the product description you cannot cancel the contract between you and us in this way. If you wish to cancel your contract please contact us at returns@simplyrooms.co.uk for an Exchange/Return form. Please note that you will be responsible for the cost of returning the goods to us.

Refund Policy

At Simply Rooms we want you to be happy every time you shop with us. Our no quibble guarantee means that if for any reason you are unhappy with the product you have just purchased, you can return it to us (with the exception of personalised goods). If you wish to exchange or return a product, please contact us for an Exchange/Return form at returns@simplyrooms.co.uk within 14 days from the date of delivery.

Returns Information

Please note our address is not a returns address, we will provide full instructions on how to return your item on receipt of your completed Exchange/Return form.

The product must then be returned to us within 30 working days of requesting an Exchange/Return form. On receipt of the product we will happily send you an exchange or refund the original price of the product.

We regret that postage, packing and insurance incurred in the delivery of the goods to you are direct costs and therefore cannot be refunded except in the case of cancellations.

You must take reasonable care of the goods whilst in your possession and they must be returned to us in a re-saleable condition along with the original packaging.

Please note that you will be responsible for the cost of returning the goods to us and will remain responsible for all returned goods until they reach our warehouse or our supplier, therefore we strongly advise that you obtain a free Proof of Postage Certificate from the Post Office when returning any part of your order. If the item is faulty, we shall pay the reasonable postage costs of returning the goods to us.

Please note due to reasons of hygiene, we are unable to exchange or accept the return of mattresses, mattress and pillow protectors, duvets and pillows once the hygiene seal (packaging) has been opened unless damaged. This does not affect your statutory rights.

If the product is faulty you should contact us in the first instance at returns@simplyrooms.co.uk within 7 working days from the day after the date of delivery. We shall assess whether a replacement, repair, refund is in order.

All returns and exchanges will be processed as soon as possible after arrival.

Furniture

If your furniture is damaged or faulty, please contact us within 7 working days of the day after the date of delivery for an Exchange/Return form which must be completed and returned to us at returns@simplyrooms.co.uk. We will arrange for collection and either replace your furniture item as soon as possible or refund you in full.

Should you change your mind when the furniture arrives and you no longer want the goods, collections arrangements will be promptly made at your cost. If we collect the item from you, we will charge you the cost of collection (up to £100 in some cases). You will be notified of the charge at the time of cancellation. You must inform us of the cancellation of the contract by email at sales@simplyrooms.co.uk within 7 working days from the day after the date of delivery.

Please return all furniture with its original packaging.

We cannot accept returns of furniture once assembly is part or fully completed, unless the product is found to be faulty.

Important Note: For all items please do not dispose of the packaging until you are completely satisfied with your purchase.

8. Data Protection/Privacy

Our privacy policy is accessible here. Our privacy policy is an integral part of these terms and conditions and you shall be deemed to have read and accepted our privacy policy by accepting these terms and conditions.

9. Security

We are passionate about the service we offer at Simply Rooms and that includes our approach to security. Maintaining your privacy is a priority which is why we use Sage Pay (formerly Protx), a third party payment specialist. They are the largest independent payment processor in the UK and are compliant to the highest level in payment card industry data security standards (PCI DSS). So you can be assured that all the information you enter is safe and secure.

We won't capture or store your card details and once you have entered your card number into a payment page securely hosted by Sage Pay, all sensitive data is encrypted and sent to the banks for processing.

For further verification, as you go through the order process, an unbroken key or closed padlock symbol will appear at the bottom of your screen or lower bar of your browser, showing that encryption is active and your information is secure.

Once your transaction has been submitted, you will be automatically redirected back to our site where you will receive a confirmation regarding your order.

Through Sage Pay, we have also enabled 3D Secure (Verified by Visa and SecureCode by MasterCard). This is an additional check to confirm no one but you is using your card. This box will appear and ask you to enter a selection of characters from your password e.g. first, third and fifth character. So don't be alarmed if this additional check appears.

10. Intellectual Property

The contents of our website are protected by international copyright laws and other intellectual property rights. The owner of these rights is Simply Rooms Limited, its affiliates or other third party licensors. All Product and company names and logos mentioned in our website are the trademarks, service marks or trading names of their respective owners, including us. You may download material from our website for the sole purpose of placing an order with Simply Rooms Limited or using our website as a shopping resource. However, you may not modify, copy, reproduce, republish, upload, post, transmit or distribute, by any means or in any manner, any material or information on or downloaded from our website including but not limited to fixed, graphics, video, messages, code and/or software without our prior written consent, except where expressly invited to do so, for example in order to complete any test or questionnaire.

11. Liability

We promise that for any Product you purchase from our website:-

  • we have the right to sell the Product to You;
  • the Product will correspond with the description We have given to You;
  • the Product will be of satisfactory quality; and
  • will be fit for purpose.

We exclude all other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regard to any Products (including without limitation Products), our website, or any information or service provided through our website.

We accept no liability for any indirect or consequential loss or damage or for any direct or indirect loss of data, profit, revenue or business in each case, however caused even if foreseeable in circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of our website or its contents other than as a direct result of purchasing Products (which shall be subject to the exclusions and limitation of liability set out in these Terms and Conditions), we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of Simply Rooms Limited or our servants, agents or any other person or entity.

If we are liable to you for any reason, our liability will be limited to the amount paid by you for the Product concerned. This limit does not apply to any liability we may have for death or personal injury resulting from our negligence or for our fraudulent misrepresentation.

The limitations and exclusions in this clause do not affect your non excludable statutory rights and only apply to the extent permitted by applicable law.

12. Alteration of Terms and Conditions

We reserve the right to make changes to our website, policies and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these terms and conditions is required to be made by Law or Government Authority (in which case it will apply to orders previously placed by you). You agree not to change these terms and conditions from the Form presented by Simply Rooms Limited.

If any part of these terms and conditions shall be deemed unlawful, void, or for any reason, unenforceable, then that provision shall be deemed to be severable from the conditions and shall not affect the validity and enforceability of any of the remaining provisions of these terms and conditions.

13. Linked Sites

Simply Rooms Limited make no representations whatsoever about any other websites which you may access through our website or which may link to our website. When you access another website you understand it is independent from Simply Rooms Limited and that we have no control over the content or availability of that website. In addition, a link to any other website does not mean that Simply Rooms Limited endorses or accepts any responsibility for the content, or the use of, such a website and Simply Rooms shall not be liable for any loss or damage caused or allowed to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other website or resource. Any concerns regarding any external links should be directed to its website administrator or webmaster.

14. Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of Scotland and You irrevocably submit to the exclusive jurisdiction of the courts of Scotland.
